Please read these Terms and Conditions ("Terms") carefully before using the services or website provided by Evolving Healthcare ("we", "our", or "us"). By accessing our website or engaging with our services, you agree to be bound by these Terms.
1. Acceptance of Terms
By using our website or booking any of our care services, you confirm that you are at least 18 years of age (or acting on behalf of an eligible person with proper authority) and that you accept these Terms in full. If you do not agree to any part of these Terms, please do not use our services.
2. Services
Evolving Healthcare provides home care and support services including, but not limited to, personal care, companionship, well-being checks, home care assistance, and related care coordination services. All services are subject to an initial assessment and a formal care agreement between you and Evolving Healthcare.
We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice. Services are delivered subject to carer availability and geographic coverage.
3. Booking and Appointments
- Appointment requests submitted through our website are subject to confirmation from our team.
- We will contact you within one (1) business day to confirm availability and agree on a care schedule.
- Evolving Healthcare reserves the right to decline a booking at its discretion.
- Any changes to a confirmed booking must be communicated at least 24 hours in advance.
4. Fees and Payment
Fees for services will be communicated during the assessment process and set out in your individual care agreement. Payment terms are as agreed in that care agreement. We reserve the right to update our pricing with reasonable prior notice.
Failure to pay outstanding invoices may result in the suspension or termination of services.
5. Cancellation Policy
- Client cancellations — requests to cancel a scheduled visit must be made at least 24 hours before the scheduled start time. Late cancellations may be subject to a cancellation fee as set out in your care agreement.
- Service provider cancellations — in the event we need to cancel a visit, we will provide as much notice as possible and endeavour to arrange a suitable replacement.
6. Responsibilities of the Client
You agree to:
- Provide accurate and complete information during the assessment and booking process.
- Ensure a safe working environment for our carers at all times.
- Notify us promptly of any changes to health status, care needs, or emergency contacts.
- Treat our staff with respect and in accordance with applicable law.
- Not request our carers to perform tasks outside the agreed care plan.
7. Responsibilities of Evolving Healthcare
We agree to:
- Provide services with reasonable care and skill.
- Ensure all carers are appropriately trained, vetted, and hold valid references.
- Maintain confidentiality of your personal and health information in accordance with our Privacy Policy.
- Communicate any issues or changes that may affect your care in a timely manner.
8. Limitation of Liability
To the fullest extent permitted by law, Evolving Healthcare shall not be liable for any indirect, incidental, or consequential loss arising from the use of our services or website. Our total liability to you in respect of any claim shall not exceed the total fees paid by you in the three (3) months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited by law.
9. Intellectual Property
All content on our website — including text, images, graphics, logos, and software — is the property of Evolving Healthcare or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
10. Third-Party Links
Our website may contain links to third-party websites for your convenience. We do not control or endorse those websites and are not responsible for their content, privacy practices, or services. Accessing third-party sites is at your own risk.
11. Termination
Either party may terminate the care service agreement with reasonable written notice as specified in the care agreement. We reserve the right to terminate services immediately if a client breaches these Terms or creates an unsafe environment for our staff.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page will reflect any changes. Continued use of our services after an update constitutes your acceptance of the revised Terms.
